Issue playing MP3's via Symbian S40 device?

I recently purchased the Halo 4 official soundtrack and it came with a card to download 6 free tracks which i downloaded. They play fine on my computer, but I've tried a number of times to put them on my Symbian S40 phones, and it says they do not recognize the file format. Is it because the songs are compressed at 320kbps? is it legal to use VLC media player to change it to 128kbps?

Well, even I used to face the same problem, anything above 192kbps failed to play on my S40 device. So, you should consider reducing the bit rate of the songs before transferring them to your device.
I don't think you'll be able to reduce the bit rate by using VLC, you can use some other software, and its perfectly legal to do so.
