bittorrent upload speed higher than allowed?

I have set an maximum upload speed of 5kb/sec both in preferences and manually per torrent.
Yet it is downloading (from a single source, not multiple peers) over 200kb/sec.

I do not want this. Why is it not following the settings i've set?

I've set the max UPLOAD speed to 5kb/sec, and it is UPLOADING over 200kb/sec.

Because uploading is different than downloading.
