My laptop's Dvd writer and reader reads all the DvDs ans Cds as if they were empty! I even tried them on other computers and they work normally, don't know why or when.. please help

I have a whole stack of CD cases with no CDs that've just been sitting in a shelf in our living room for years. Would it be legal to torrent such CDs? What about CD games I own? Like Empire Earth, I have the case in a drawer but not the disk.
