has anyone read the short story bargain?

its from a 7th grade literature. its about a guy who owns a store and makes this guy named slade pay his debt but he never does. they get into two fights and mr baumer gets a broken wrists. anyways in the end, mr baumer kills him using wooden alchohol because slade thought it was beer and he couldnt read. uhm then our teacher makes us pretend hes in the court place and im supposed to prove him guilty or not guilty. and uh i have to mention the counterargument. i need help!
well i have to write a 5 paragraph persuasive essay to say that mr baumer is guilt or not guilty. its due on feb. 13th. so help me find some reasons to prove that mr baumer is guilty or not. uhm list them. the one with the most reasonable is the best one.
