No they should not be penalized unless they have any ownership of the product production company. Otherwise they are just a "paid presenter" for the product.
You do not see any infomercials where the actor in his/her pitch make a statement that " the product is so good that I invested a large amount of my personal cash into the company that makes this product because it is so great" do you?
If you ever hear this pitch during an infomercial ... let me know..lol
No. A celebrity is paid to appear in commercials, and is generally not in any way affiliated with the product development.
