My husband left me in a truck that's in my name. What should I do?

Should I go take the chance and go over there and get it? Which I really don't want to do cause there might be a big argument started...

Other than that option, does any one know what I should do?

It doesn't look like he's going to pay the insurance on it..

I know he's got the right to it as well as me cause we are still legally married.
Does any one have any suggestions?

What if I find someone to buy it for dirt cheap just to get it outta my name, as long as I use the excuse in front of a judge during the divorce and say like "I needed the money for our child, or I took it back cause he did not pay the insurance on it", will that work? Will a judge buy that?

Does anyone know would it look better if I donated it to a charity?

Those "cash for cars running or not places" does anyone know if they would let me sign the title over to them first and get it towed to their place and then talk about the payment? Will that work?

If I did sell it "before" any divorce papers have been filed, during the divorce later, will my husband be able to ask for half of what I got for it, even if I used all the money on things for our son?

    Texas

Quit asking what you COULD do and decide what you want to do. When your decision is made, file for divorce and seek a court order for the same.

No, you call the police and go with them to get it!

Sell it if you need to get out from under the costs, or keep it, but don't let him ruin your credit.

It is yours to sell and is not necessarily community property. Especially at this point.

Cash for cars (title loans) is a rip off! STAY AWAY from them!

You don't have to explain to a judge why you took back a vehicle that belongs to you. If you sell it and spend the money prior to the divorce, how the hell could he expect to get half of the value. He's not going to be giving you half of the money that *he's* spent during the marriage.

Don't worry about starting an argument. Get in the car and go. He apparently wasn't worried about starting an argument with you when he left with it. Why would you give him that sort of power over you? He left you. You don't have to explain your actions to him anymore....

contact the police tell them what is going on and ask them what you should do, don't take advise from strangers about this issue as no one knows your Ex better than you, so ask police what to do to protect yourself from being sued because of no insurance and they will give the best advise. As for turning him in won't that just make it worse?

First, talk to your local police department. See if you can file a stolen vehicle report so that if he does get into trouble while driving the vehicle it won't affect you. I know in Tennessee you can't do anything like sell the vehicle or donate it to charity without giving him half of the profit. (cash or tax credit) Also, try talking to a lawyer about this, a lot of lawyers will do free consultations with first time customers and they could tell you more on what your rights are on the matter as well as how you can get more support for your son. Good Luck and God Bless!

You should really go speak with a divorce attorney that also understands the tax implications of what you might do under the circumstances. If you actually sell the truck, you should make sure that you get close to the market value, they could come back on you.

If the title is in your name, it's your truck. Wether you were married at the time is irrelevant. If you decide to give it to him in the divorce, that is one thing. But since it's in your name and you made payments on it, it's your truck. Tell him to return it or you will call the police and file it as stolen.
