Why is the game "Bionic Commando" on Xbox Live Arcade rated "M" for 17 or older?

I'm 56 years old, and I've been a gamer gamer since Pong. I own many game systems and I'm knowledgeable about the whole thing.
This particular game is a remake of an old game that came out on the 8 bit Nintendo many years ago. I think the ESRB has missed the rating here by about 2 steps. No way does it deserve a rating that severe.
I'm hoping for an intelligent, knowledgeable answer from someone, possibly a software publisher or a game developer.

I want to play this game with my 9 year old son, but the rating will make my wife nervous. Help!

Violence. It's a side scrolling game with guns.

Just because it's old, doesn't mean it isn't violent. You know what else was on the original Nintendo? Metal Gear Solid, also rated M.

It doesn't take much violence to get an M rating though.
