what happens to an illegal alien after they've been picked up by I.C.E.?

he was here illegally for about 4-5 years & was picked up by an I.C.E. agent. i know he has a baby here. does the court go easy on him? & what kind of facility would he be held at? he's been there now about a month. personally i hope he is deported. he is a criminal after all...
