Diablo 2, Error 22 a critical error has occurred while initializing Direct Draw?

I have tried everything under the sun except the right thing, I have Vista and am using a Radeon HD 4870 card can i run Diablo 2 with this?
I also have DirectX10 and all updated drivers for my fx card
