TELUS policy is that you have to be within the last 6 months of your contract AND be willing to resign a new commitment in order to qualify for a subsidized phone. You can upgrade/change your phone at any time by buying a new one from TELUS at full price or by finding a used TELUS phone on ebay or kijiji. Some people buy TELUS pay&talk phones (because they're cheaper) and transfer the esn to their current account to replace the phone that they no longer want.
