\xbox306 scratched disks?

Brought new 360 2-3weeks ago. Not played it much, just brought Fable, now after and hour Fable froze, so i rebooted it.
So far its frozen 5 times, Fable was new, disk is clean.
I then noticed the disk was making a funny noise.
Now the disk is scratched and the 360 is unable to read.
I am now playing Saints Row 2 and its not saving my games properly - im loosing a few % each time now. And Yes I am saving it correctly.

Do i take the 360 back to Game where I got it from? I doubt ill be able to claim for Fable, as it was off Ebay.

is it a scratch or a big ring around it ? if so its called laser burn and its caused by a faulty disk drive, if it is you need to send it off to microsoft and theyll replace it and also give you vouchers for new games absaloutley free !!!
