    well the insurance should cover it, and if your mom doesnt have insurance the person who hit you's insurance should still have to cover it!!

    You have to wait until the insurance companies pick it up and they will take care of it. You can't just jump into suing or just pick a number to sue a person for out of the blue. It has to be a fairly calculated number.

    my mom was in a car accident, should she sue?

    my mom was just in a car accident.
    she was rear ended by a car that was doing at least 45mph.

    so now we are out a car and don't have any money to buy a new one.
    so my question is should she sue and what for?

    any help would be good.

    yeah my mom has insurance, but the car isn't worth much so its not gonna pay for a new one.

    she is having neck and back problems.

    Yes, sue for damages, injuries, time off work. Hire a lawyer that works on contingency. They usually take a third of the settlement.

    Yes but get a lawyer. It's not DIY. And plan on it taking time to resolve.

    Insurance should cover it. If she was driving with no insurance then like many others that choose to do that she is SOL!

    well you could sue for all injuries that accord if it was not her fault at all. You could sue for both physical and any emotional, the car should be repaired by the other persons insurance agencey if they do not have insurance you may also be able to sue over that. I suggest though you take your case to a lawyer, either way you would need one, since you can sue for anything medical. Casts, braces, prescription and if you can prove emotional damage done you could get around 30-80 thousand, most likely lower. But yes i do suggest you see council and get there opinion on your case. they will want a percentage. Also ask them to do it probono if they will. (means free if they dont win anything.)
