    Obama told us that the health care mandate is not a tax. Why are they arguing in...

    ...the court that it is a tax?

    Okay, if it is a tax then do we have Obama on video lying to us?

    If this gets pushed through we will not have to pay Workman's Compensation either.

    How is it that liberals are concerned for the welfare of Republicans, their families, and friends but republicans don''t want to reciprocate? How can anyone be so selfish?

    I also wonder how many republican will go without any health insurance if national medicine blocked.

    Enforcing taxes is legal.
    That's the only way they'll be able to pass this through.

    Too bad the public can't vote on it.

    And since it's a HUGE tax increase, we should have a say.

    From what I've read, it is a tax. Forcing a person to pay for something, or else they shall be fined or, if further resisted, imprisoned, is the exact definition of a tax.

    Because a penalty is unconstitutional

    congress has the right to tax, so they changed their argument.

    unfortunately it is not called a tax in the bill, thus the ruling

    SC rules 5-3 unconstitutional, unless Kagan refuses to recuse herself then it's 5-4

    Talk to a lawyer because you MISUNDERSTAND the legal argument.

    The MANDATE is not a tax.... it is a regulation on interstate commerce. That is.... if you already have insurance... nothing will change for you.... i.e. obviously NOT A TAX..... because you don't have to spend a DIME extra.

    Citizen failure to ABIDE by this Federal Law..... is punished via a PENALTY.... which could certainly be construed as a tax penalty. Which is FINE...because the Congress has the power to tax and spend.

    Your failure understand the difference..... does not mean there is not a legal difference.

    @Skyhawk.... if Congress does not have the power to issue "civil penalties" are you arguing that ALL FEDERAL FINES are illegal. I think you are.... and I KNOW YOU ARE WRONG.

    I.R.S. has been issuing "civil penalties" with "Congressional authority to do so" for going on 100 years now.
