    Legal Possession - iPhone trade.?

    I traded someone I knew my Blackberry and a Palmpilot for a first gen iPhone 8gb. Now they want to trade back. I don't.

    I keep telling him possession is 9/10 of the law.

    But he doesn't believe me.


    If he talks to the police or something, am I the rightful owner? We made a trade.

    If he changed his mind,,,, you should trade back....legally when you make a transaction as such you have 3 business days to change your mind and get a do over!

    Was there a contract signed in the trade? Does he still have posession of your phone?

    If the phones are still on contract with the wireless company in the other person's name then yes, it is still his.

    You swapped, therefore you are the rightful owner.

    The only thing that could cloud the issue is if any of the equipment was on non-transferrable terms then bought, or on a non-transferrable contract.

    PS: The comment in one answer about 3 business days to change your mind only applies to commercial sales, not to swaps or private sales.

    He can't do anything legally. The worst he could do is to call the carrier, say the phone was lost/stolen, and it would be suspended from the account (This is, if you haven't already switched the phone to your account(instead of just switching the SIM)

    If that happens, not a lot you could do, except do the same thing to him, or trade back.

    No, he doesn't have to trade you back unless you had a contracting stating that he has to under this condition.
